These Terms of Service ("Terms") govern your use of the Gogaku mobile application (the "App") and the website at gogakuapp.com (the "Site"), together the "Services". The Services are operated by Philomath Tech LLC, a Texas limited liability company ("we", "us"). By using the Services, you agree to these Terms. If you do not agree, do not use them.
You must be at least 13 years old to create an account or use the App. If you are under 18, you must have permission from a parent or legal guardian. The Site's public pages, including the online dictionary, articles, and reference sheets, may be browsed without an account.
An account is required for the App and is not required to browse the Site. You are responsible for maintaining the security of your account and password, for providing accurate information when creating an account and keeping it current, and for all activity that occurs under your account.
You may not share your account with others, sell your account, or use someone else's account without permission.
Everything published on the Site is free and requires no account, including the dictionary, articles, and the hiragana and katakana reference sheets.
Without paid access, the App provides the first lesson, the dictionary, the hiragana and katakana reference sheets, and up to five flashcard decks that you create yourself. The remaining lessons, the full flashcard capability including lesson-generated and conversation-generated decks, the conversation features, and the remaining reference sheets require paid access.
Paid access is offered as an auto-renewing monthly or annual subscription. Current pricing and the features included at each tier are displayed in the App before purchase. Payments are processed by Apple through the App Store. By subscribing, you authorize Apple to charge the payment method on file.
New subscribers may be offered an introductory free trial or discounted introductory pricing. If you do not cancel before a trial period ends, the subscription converts to a paid subscription at the then-current price. Availability, length, and terms of any trial or promotion are shown in the App at the point of purchase. We may offer, change, or withdraw trials and promotions at any time.
Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel subscriptions in your Apple Account settings.
Refund requests are handled by Apple in accordance with Apple's App Store refund policy. We are not able to issue refunds directly.
We may change our pricing from time to time. Existing subscribers will be notified of price changes in advance and may cancel before the new price takes effect.

The in-app conversation and tutoring features are powered by a third-party large language model provided by OpenAI, L.L.C. Responses are generated automatically and may occasionally be inaccurate, incomplete, or inappropriate. Generated output should be treated as a learning aid, not as authoritative instruction. You are responsible for verifying important information through other sources.
Do not share sensitive personal information, financial details, passwords, or confidential data through the conversation features. See our Privacy Policy for how these messages are processed.
The Services, including the lessons, the dictionary compilation, the articles, the reference sheets, the design, the code, and the branding, are the property of Philomath Tech LLC and are protected by copyright and other intellectual property laws. The selection, arrangement, annotation, and presentation of the dictionary entries are our compilation, independent of any individual word or definition.
You may use the Services for personal, non-commercial language learning. You may not copy, redistribute, or republish their content without permission.
You retain ownership of content you create within the App, for example custom flashcard decks and notes. You grant us a limited licence to store and process that content as necessary to provide the App's features.
The stroke-order animations shown on the Site come from the AnimCJK project, which derives from the Make Me a Hanzi project and the Arphic PL KaitiM fonts. They are used and redistributed under the terms of the Arphic Public License, and each file retains its original copyright notice. These materials remain the property of their respective authors and are not covered by Section 6.
We may change, suspend, or discontinue any part of the Services at any time, including features described on the Site. The Site may occasionally be unavailable for maintenance or for reasons outside our control.
You may delete your account at any time from within the App. We may suspend or terminate your account if you violate these Terms or attempt to harm the Services or other users. Upon termination, your access to paid features ends, though you may still request data export or deletion as described in our Privacy Policy.
The Services are provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that they will be uninterrupted or error-free, or that any errors will be corrected. We do not guarantee that dictionary entries, lesson content, or generated output are accurate or complete, and we do not guarantee any specific language-learning outcome.
To the maximum extent permitted by law, Philomath Tech LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services will not exceed the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.
We may update these Terms from time to time. If we make material changes, we will notify users through the App or by email and will update the effective date above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions.
